After a nine-day trial in the United States District Court for the Central District of California, Southern Division (Case No. 8:11-CV-00452-AG (FMO)),it was decided that Mixed Chicks suffered $839,535 in actual damages and found Sally Beauty acted willfully and with malice, oppression, or fraud, resulting in a punitive damages award of $7,275,000.The jury deliberated approximately six hours before reaching its verdict.<\/p>\n<p>&nbsp;<\/p>\n<p>Co-founders Kim Etheredge, Wendi Levy and Bradley Kaaya set a precedent for small businesses that might be too afraid to take on a multibillion-dollar company. \u201cWe invested our hearts and souls into this company and have built the reputation of the Mixed Chicks products as one of distinction and high quality. \u00a0It was an expensive case, but we believe in our brand and will fight to protect it.\u00a0 We are pleased the jury has found Sally Beauty willfully infringed and awarded an amount that will make them think twice about doing so in the future. You can&#8217;t just bully little companies.\u201d said the trio about their unwavering commitment and monumental win.<\/p>\n<p>&nbsp;<\/p>\n<p>Upon introduction and guidance by general counselor Marea A. Barsky, Esq. of Mortensen &amp;Reinheimer, PC,\u00a0 \u00a0Mixed Chicks acquired the representation of Kenneth G. Parker and Alan R. Wechsler of Haynes and Boone, LLP, at trial.<\/p>\n<p>\u201cWe are so happy for our client,\u201d Mr. Parker said.\u00a0 \u201cMixed Chicks showed more courage and resolve than I have ever seen from any client in a similar case.
